【劳动安全问题的现状及法律对策】

摘要：劳动安全是生产经营活动中的永恒主题。劳动安全问题是经济建设中必然会遇到，也必须妥善解决的问题。尽管我国党和国家高度重视劳动安全问题，并为此采取了一系列行政的、经济的和法律的措施，也确实取得了较好的效果。但从总体上讲，劳动安全形势十分严峻，重大生产安全事故时有发生，严重威胁和影响着劳动者的生命安全与身体健康，也严重影响着经济建设与社会稳定。为妥善地解决这一问题，本文进行了积极有益的探索，认为劳动安全形势严峻的主要原因是劳动安全问题在立法上存在着空白和矛盾，在执法上存在着严重不足，尤其是一些生产经营单位的负责人或业主不重视劳动安全，不认真落实安全生产责任制，而劳动者又缺乏安全意识与安全技能。进而提出了应对措施，即要按照依法治国方略，建立起一套完整的劳动安全方面的法律体系，并要强化这些法律规范的实施，使劳动安全问题真正得到落实，从而达到劳动安全形势的根本好转。

Atract:Laborsafetyistheeternalthemeinthemanufacturingandmanagingfields.Theiueoflaborsafetycannotbeavoidedinthedevelopmentofeconomy,soitshouldbesolvedproperly.AlthoughthePartyandthegovernmenthaveplacedhighimportanceontheiue,adoptedaseriesofadministrative,economicandlegalmeasuresandachievedsomecomparativelygoodeffect,thesituationremaisevereasawhole.Bigaccidentsduringproducinghaenoccasionally,whichnotonlystronglythreateandaffectsthesecurityandhealthoftheworkers,butalsoharmstheeconomicdevelopmentandsocialstability.Inordertosolvetheproblemproperly,thethesisiswrittenonthebasisofavigorousandbeneficialexploration.Itisputforwardinthethesisthatthecauseoftheseveresituationinlaborsafetyliesmainlyinthegaandconflictsoflegislating,theseriousweakneofexecutingandeeciallysomeleadingcadresandproprietors,whodon’tattachimportancetolaborsafetyorputthesystemofjopeoibilityregardingsafeproductionintoeffectandsomeworkerswhoareshortofsafetyawareneandskills.Soaropriatemeasuresareprovidedinthethesis.Inaccordancewiththegeneralplanofruingthecountrybytheruleoflaw,weshouldestablishacompletelegalsystemgoverningthelaborsafety,strengthentheexecutionsoastotrulycarryoutthemeasuresandfundamentallymakethesituationtakeafavorableturn.
